Why have local laws?

Under the Local Government Act, Local Governments are able to create local laws they consider to be necessary to perform any of their functions. These local laws created by the City of Kwinana do not apply outside of the district.

If a situation or problem emerges in a local government area that is causing a nuisance that cannot be controlled under the Local Government Act or State or Federal Legislation, consideration of making a law to control the situation may be deemed necessary.

Before the City can create a local law, a clearly established need for the law must be identified.

Local law review

The City of Kwinana is undertaking a review of its local laws and is inviting the community to provide feedback. This review is all part of an effort to confirm local laws remain necessary, effective and aligned with current legislation and community expectations.

Six local laws are currently open for feedback:

  1. Activities on Thoroughfare and Public Places and Trading Local Law 2011
  2. Adoption of Health Act 1911 Model By-Laws Series ‘A’ (as amended)
  3. Dogs Local Law 2016 (as amended)
  4. Draft Pest Plants Local Law 2026
  5. Extractive Industries Local Law 2001 (as amended)
  6. Fencing Local Law 2016
