Development contractor Mammoth Construction Pty Ltd prosecuted and fined $100,000 for serious breaches of the Planning and Development Act 2005 including storage of sand in a conservation wetland.

The City of Kwinana successfully prosecuted development contractor Mammoth Construction Pty Ltd on 31 July, when the company pleaded guilty in Rockingham Magistrates Court to two charges under the Planning and Development Act 2005.

Mammoth Construction pleaded guilty to one charge of breaching the conditions of subdivision approval, and also to one charge of development without approval for the storage of bulk sand in a conservation wetland off Treeby Road, known as Sandy Lake.

The Magistrate imposed a global penalty of $100,000 to be paid to the City, and the Magistrate also ordered the company to pay costs, totalling $3093.

Chief Executive Officer Wayne Jack said this result is testament to the diligence and thorough work of the City’s Compliance and Planning teams.

“This successful prosecution also sends a strong message to other developers that the City will pursue serious non-compliance,” Mr Jack said.
