The role of the Town of Kwinana in relation to dividing fences is to prescribe the minimum standard of fence and consider applications for over height fences. The minimum standard of fence and its requirements are set out in the Local Law Relating to Fences. A copy of the local law can be obtained from the Administration front counter or downloaded below.
The Town has no jurisdiction when it comes to disputes between neighbours over the dividing fence as this is covered by the Dividing Fence Act 1961. This is administered by the Department of Housing and Works. Should you intend to construct a fence forward of the front building line including at the front cadastral boundary line, it will be necessary to complete a fencing application form and submit it, along with drawn details of the fence. This would include a site plan illustrating the entire site (Scale 1:200), including all existing and proposed buildings. Additionally provide drawings of the fence including an elevation (Scale 1:100), and construction details (Scale 1:20).
Note: A solid fence is not permitted to exceed 1.2m in height as measured from the original ground level at the front boundary. Fences over 1.2M up to a maximum height of 1.8M must be visually permeable as required under the Residential Design Codes.
